By visiting or attending any 4040 House light show, you acknowledge that you have read, understood, and agree to the following terms and conditions. These terms are also posted at Event entry points.
Assumption of Risk & Liability
Voluntary Assumption of Risk
By visiting or attending any 4040 House light show (the "Event"), you understand and voluntarily assume all risks associated with attendance, including, without limitation, risks of:
- Slips, trips, falls, crowded walkways/sidewalks
- Uneven surfaces and low light conditions
- Weather conditions (rain, snow, ice)
- Traffic and parking areas near the Event
- Noise/sound levels
- Incidental contact with other attendees or property
You are responsible for your own safety and the supervision of any minors in your care.
Release & Waiver (Adults)
To the maximum extent permitted by Washington law, you release and discharge 4040 House and Pixel Design Group, LLC, and their owners, members, managers, employees, volunteers, contractors, sponsors, and agents from any and all claims or losses for injury, illness, property damage, or death arising out of or related to your attendance at the Event, whether caused in whole or in part by ordinary negligence.
This waiver does not apply to gross negligence or willful misconduct.
Minors
We welcome families, but Washington law does not allow parents/guardians to waive a minor's own negligence claims in advance.
- Parents/guardians agree to supervise minors at all times
- Parents/guardians accept responsibility for their minors' compliance with posted and verbal safety instructions
- Children must be supervised at all times
- Nothing here limits a minor's rights where the law does not allow it
Indemnity
You agree to indemnify, defend, and hold harmless the above-named parties from any third-party claims arising out of your acts or omissions at the Event (including damage you cause to persons or property).
Safety Guidelines & Rules
Personal Property
We are not responsible for lost, stolen, or damaged items. Please do not leave valuables unattended.
Safety Instructions
For everyone's safety, you must:
- Follow all posted signs, barriers, cones, and tape
- Obey traffic guidance and parking instructions
- Follow all volunteer and staff instructions
- Stay out of roped-off or private areas
- Keep sidewalks clear for pedestrian traffic
- Use designated crosswalks when crossing streets
Prohibited Activities
- Drones are prohibited without written permission
- Commercial photography/recording requires advance permission
- Blocking driveways or fire hydrants
- Entering private property beyond designated viewing areas
Be a Good Neighbor
Please help us maintain good relationships with our neighbors:
- Keep noise levels reasonable, especially after 9 PM
- Don't block driveways or mailboxes
- Park legally and considerately
- Take any trash with you
- Be respectful of neighboring properties
Event Operations
Weather & Changes
The Event is subject to cancellation, delay, or modification due to:
- Severe weather conditions
- Safety concerns
- Technical issues
- Emergency situations
Changes may occur without advance notice. Check our website or social media for updates during severe weather.
Medical Emergencies
- You are responsible for your own medical needs
- In an emergency, you authorize Event personnel to seek basic first aid or emergency assistance
- Call 911 for serious medical emergencies
- Alert Event volunteers if you need assistance locating emergency services
Photography/Recording at Events
We and other attendees may capture photos/video at the Event. By attending:
- You may appear incidentally in media used for Event promotion
- You consent to such incidental appearance in promotional materials
- If you wish to request removal of a specific image featuring you prominently, contact privacy@4040house.com
- We'll make reasonable efforts to honor removal requests when feasible

Posted at Entry Points
"By entering, you acknowledge and assume all risks associated with attending the 4040 House light show and agree to the terms posted at 4040house.com/risks"
Signage Locations
Risk acknowledgment and safety signage is posted at:
- Sidewalk entry points (waist-high and eye-level)
- Driveway access areas
- Primary viewing areas
- Parking guidance locations
- Areas with specific hazards (uneven surfaces, steps, etc.)
Additional Posted Reminders
- "Children must be supervised at all times"
- "Keep sidewalks clear - Be a good neighbor"
- "Follow volunteer instructions"
- "No drones without permission"
- "Private property - Stay in designated areas"
- Weather-specific warnings when applicable
Legal Notes
Washington State Law
These terms are designed to comply with Washington state law, which:
- Permits assumption of risk and liability waivers for ordinary negligence
- Does not permit waivers of gross negligence or willful misconduct
- Does not allow parents to waive their children's future negligence claims
- Requires clear and conspicuous notice of liability limitations
Severability
If any term is found unenforceable, the remaining terms remain in effect.
